TURTLE, DON'T LET THE INSURANCE PEOPLE PUSH YOU AROUND.
when my cbr was stolen, they offered me shit-all, i did not take it, i told them, i need to be able to buy simmilar bike (milage and year). so they offered me more, gave me adds off simmilar cbr's for sale, took an average price. i still did not take it, because they pulled out adds from some vilages in quebec, 1000 km away. of course they are cheeper there, who would want to go there? (+ i don't speak french). so i gave them all the adds i could find within 300km, which there were 3. they took an average of that, added taxes and dealer fees, added allowable upgrades, and i accepted it.
in total i got $13000, (i think their 1st offer was around 9000), which is pretty good (05 1000rr, 10K km), though of course they did not cover all aftermarket stuff, which there was plenty off. they asked me for receipts, which i provided, for total of ~$4000. they have 'max allowable upgrades' policy, which specify that, for example max upgrade for exhaust system cannot exceed $400 (or something like that), windsreen - $40, etc. i could not argue that, if you don't let them know, and they do not add higher value to the policy, that's all they have to pay by law.

they will always try to lowball you, but if you show them you know what it's worth and don't take shit from nobody, they should pay up more-or-less what she's worth.
good luck buddy!

Turtle, you have a sound plan and already have the wheels in motion, this is a shame for allstate insurance to conduct themselves in such a disgraceful manner as this, I have had statefarm and alway had good luck with them, they had cut me a check in less than a week when my 06 gsxr was nicked. now I am with AIG. so the only time you know is when you need it.

good luck my friend,
joe
Surprise, surprise... Allstate has not, as yet made it out to look at the bike, after promising yesterday that it'd be done within the day...

Surprise, surprise... Beaudry Motorsports has not seen to getting me the refund for my unused extended warranty, promised last week, and yesterday...

Another ... for good measure...

If the accident wasn't your fault, then how about getting a "no win no fee" solicitor to recover your uninsured losses that your insurer won't cover ?

That can include bike rental, loss of use, all rider gear you were wearing including crash helmet, leathers, boots, gloves, etc; plus any other aftermarket parts - regardless of how exotic. If you were injured - even minor then $$$

I've just been thru this myself & considering I only had basic insurance & no legal cover, my insurance brokers - Bennetts - were fantastic. In the end it was settled 50/50 but that was still plenty enough $$$ for me
That'd be great... Except, the bitch who ran me off, hasn't got a pot to piss in. 24, living with Mom, no job, no license, no car, and knocked up to boot. The worst I can do it mess up her credit for a couple of decades. It hardly seems worth the effort, just to make someone miserable. I'm a bastard, but even I can't see the point in that.

At any rate, I've secured financing for my new Daytona, until the insurance pays out, then I plan to pay the new loan off fast. I don't like having payments, almost as much as I dislike not having wheels.
